Agreement between User and Zouma

The Zouma Creative Studio Pvt Ltd, (Zouma) website is comprised of various Web pages operated by Zouma and/or Linked Sites as defined herein below (collectively “Zouma Website”).The Zouma Website is offered to you on your unconditional acceptance of the same without modification of any of the terms, conditions, and notices contained herein.You acknowledge and agree that your use of the Zouma Website constitutes your unconditional and irrevocable agreement and acceptance to all such terms, conditions, and notices contained herein and /or modified/amended from time to time by Zouma at its sole discretion.

Modification of these terms of use

Zouma reserves the right to change the terms, conditions, and notices under which the Zouma Website is offered. Zouma may at its sole discretion (without in any manner being answerable and/or called upon to justify) amend these Terms of Use at any time by updating this page. You agree and acknowledge that any changes to these Terms of Use shall also be binding on you. You agree that your continued use of the Zouma Websites or Zouma’s services shall constitute your agreement to such amendments to these Terms of Use.

No unlawful or prohibited use

As a condition of your use of the Zouma Website, you covenant, undertake and warrant to Zouma that you will not use the Zouma Website for any purpose that is unlawful or prohibited by law, these terms, conditions, and notices. You may not use the Zouma Website in any manner which could damage, disable, overburden, or impair the Zouma Website or interfere with any other party’s use of the Zouma Website. • upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
• provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the Government of India and/or any Country that has such a reciprocal agreement with the Government of India, as a foreign terrorist organization
• stalk” or otherwise harass another user or third-party
• interfere with or disrupt the Zouma Websites or servers or networks connected to the Zouma Websites, or disobey any requirements, procedures, policies or regulations of networks connected to the Zouma Websites
• provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the Government of India and/or any Country that has such a reciprocal agreement with the Government of India, as a foreign terrorist organization
• resell or make available to any non-user any of the Zouma’s services, the Zouma Websites or any content on the Zouma Websites, or use the Zouma Websites for any unlawful, commercial, research or information gathering purposes;
• use the Zouma Websites in any manner if you are a competitor of Zouma, including without limitation soliciting Professional / Candidates, or Employees of Zouma for any purpose whatsoever;
• Delete or revise any material posted by another User on the Zouma Websites, access data not intended for you on the Zouma Websites, or log into an account which you are not authorized to access.
• Please report any prohibited conduct by other Users to [email protected].
  Zouma is under no legal and/or moral obligation to monitor the conduct of Users on the Zouma Websites or any materials posted thereon, but it may respond when violations are reported. You acknowledge and agree that Zouma has the right (but not the obligation) to monitor the Zouma Websites including without limitation all postings by various Users. Without Prejudice to the Zouma’s other rights as set forth in these Terms of Use, Zouma reserves its right, with or without notice to the applicable User, to remove content posted by any User on the Zouma Websites, remove any User from the Zouma Websites, and/or take any other technical or legal action Zouma deems necessary in the event that Zouma believes, in its sole discretion, that the User is creating problems, possible legal liabilities, violating these Terms of Use, or otherwise acting inconsistently with the letter or spirit of Zouma’s policies. Zouma also reserves its right to report any wrongdoing of which Zouma becomes aware to the applicable government or law enforcement agencies or otherwise.

Materials provided to Zouma or posted at Zouma website

Zouma does not claim ownership of the materials you provide to Zouma (including feedback and suggestions) or post, upload, input or submit to any Zouma Website or its associated services (collectively “Submissions”). However, by posting, uploading, inputting, providing or submitting your Submission you are granting Zouma, its affiliated companies and necessary sub-licensee/s permission to use your Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission. This includes, without limitation, the “Zouma.com” URL; Zouma, and Zouma logo, and certain other names and logos used by Zouma, all of which are service marks or trademarks of Zouma Technology Services Private Limited, (Zouma) India. This also includes, without limitation, the “look and feel” of the Zouma Website (including design, layout, color combinations, button shapes, which is protected by Zouma’s copyrights.
